As the Adult Survivors' Act window comes to a close in New York, Jamie Foxx is the latest public figure to be sued for an alleged sexual assault.

According to the woman identified only as Jane Doe, the alleged incident took place in 2015 at the Catch NYC rooftop lounge. Doe claims she was at the bar with a friend, seated at the table next to Foxx (born Eric Marlon Bishop) and Catch NYC owner Mark Birnbaum. At around 1 a.m., her friend allegedly asked Foxx for a photo. The actor agreed, and they allegedly took several.
It was at this point that Foxx allegedly began complimenting the plaintiff. "Wow, you have that supermodel body," Foxx said, according to the document, as well as, "You smell so good" and "You look like Nickie." When Doe asked who Nickie was, Foxx allegedly answered, "Gabrielle Union."
Then, he allegedly grabbed her by the arm and led her to a more secluded area of the rooftop — where he groped her breasts beneath her crop top. The plaintiff claims to have been caught off guard and attempted to step away from the actor, but Foxx allegedly stuck his hands down her pants and "put his fingers on and in Plaintiff's vagina and anus," the suit alleges.
Doe claims that a security guard witnessed the groping but didn't intervene. When her friend came and found her, Foxx allegedly stopped touching the plaintiff and walked away.
The lawsuit goes on to claim that Doe had to seek medical treatment as a result of the assault, allegedly having been rendered unable to pursue her usual activities. She's seeking compensation for her pain and suffering, post-traumatic stress disorder, emotional distress, anxiety and humiliation as a result of the alleged assault.
Birnbaum and Catch NYC are also named as defendants, standing accused of enabling the assault by the bar staff's failure to intervene. The full filing against Foxx can be read here.
