All-American Rejects Singer Sued for Beaning Warped Tour Concertgoer with Energy Drink

While most people are keen to grab some free swag at a show, whether it's a T-shirt or snack, a concertgoer at last year's Warped Tour has just sued All-American Rejects singer Tyler Ritter after he allegedly threw an energy drink into the crowd, beaning the complainant in the process.

As the Mercury News reports, Monterey, CA resident Nina Kooroshfar claims that at the Warped Tour stop in Mountain View, CA, on June 26, 2010, Ritter was instructed by the Monster beverage company to hurl promotional cans of the energy drink into the crowd. While the intent may have been good-natured, likely hoping to both refresh and reinvigorate the punks in attendance, the plan backfired when a can walloped Kooroshfar in the dome, leaving her with a nasty head wound. She was treated at the venue, but had to be taken to hospital to receive 12 stitches.

In a lawsuit filed last month -- which follows a similar case against Insane Clown Posse in 2009 -- Kooroshfar began legal action against Ritter, Monster Beverage Co. and Live Nation, asking for unspecified general and punitive damages for negligence and assault and battery. The suit claims that she "did not reasonably expect the large drink to be thrown at her at the time and could not avoid being hit by the can thrown by Ritter."

The singer has yet to comment on the incident, but chances are he won't be throwing anything beyond guitar picks into the audience from now on. But even then, watch out – those things have points.
