Judge Rules Against Camel in Indie Rock Ad Case

BY Josiah HughesPublished May 14, 2009

As we reported early last year, Fucked Up and Xiu Xiu have entered into a pretty serious lawsuit with Rolling Stone and Camel cigarettes over an "editorial piece" that used those bands, along with a few others, to promote cigarettes. Called "Indie Rock Universe," the piece was a pretty blatant promotion for Camel cigarettes that none of the 92 bands involved had consented to.

In an update on the matter, The Daily Swarm has reported that Camel has lost a preliminary case, which reveals that they went outside of the allowed tobacco advertising rules with their sneaky product placement. As a result, a judge is requiring them to either pay a sanction of over $300,000 or run a "youth oriented anti-smoking advertisement."

While this has no direct impact on the Fucked Up/Xiu Xiu case, The Daily Swarm point out that the case proves that the "Indie Rock Universe" piece was an ad and not editorial work.

How that pays off is yet to be seen. In the meantime, how about a smoke break?
