A recent trip to Atlanta, GA found NYC rapper Fabolous served with a lawsuit that could have him facing assault charges. According to the Atlanta Journal-Constitution, the 31-year-old rap star (born John Jackson) attacked a busboy at a Georgia eatery.

The suit, which was filed January 31 in Fulton County Superior Court, alleges that Johnson and another unidentified man attacked Fox Sports Grill employee Octavius Butler. The suit contends that the incident was unprovoked. Butler claims that he was hit in the head with a glass bottle, as well as a closed fist.

This is not Fabolous's first run-in with the law. In October 2006, he was arrested for carrying an unlicensed gun. In 2007, he was suspected in the fatal stabbing of a childhood friend outside of a Manhattan nightclub. And in 2009, police found 500 pounds of marijuana on his tour bus.

Fabolous has not yet issued a statement on this most recent incident.
